BizApp247 Platform Operated by Baytech Companies, LLC
Customers using the BizApp247 platform to upload, store, manage, or communicate with contact databases represent and warrant that all contact data stored within the platform has been lawfully obtained and collected in compliance with all applicable laws and regulations.
The BizApp247 platform allows Customers to store and communicate with various types of contact information including but not limited to:
• customer contact records
• mobile phone numbers
• telephone numbers
• email addresses
• lead databases
• marketing subscriber lists
• CRM contact records
• marketing and communication databases
By uploading, importing, syncing, or otherwise entering any contact information into the BizApp247 platform, the Customer certifies that such information has been collected lawfully and that the Customer possesses the legal rights necessary to use that information for communication, marketing, or operational purposes.
Customers may not upload or use contact databases that were obtained through unlawful, deceptive, or non-compliant means.
Prohibited data sources include, but are not limited to:
• purchased marketing contact lists
• rented marketing lists
• scraped or harvested phone numbers or email addresses
• automated web scraping tools
• copied business directories
• harvested public database contact information
• social media scraping tools
• contact lists obtained from unknown or unverified lead vendors
• lists obtained without documented recipient consent
Customers may not attempt to bypass platform safeguards or technical restrictions to upload such data.
BizApp247 strictly prohibits the use of any contact lists that do not meet permission-based messaging requirements.
Customers must maintain verifiable documentation demonstrating that contacts included in their database have consented to receive communications where required by law.
Consent documentation may include, but is not limited to:
• website form submissions
• consent checkboxes
• timestamp records
• IP address records
• opt-in confirmation messages
• SMS keyword opt-in logs
• source URLs where consent was obtained
• signed agreements or electronic consent forms
BizApp247 reserves the right to request proof of consent for any contact list, campaign, or messaging activity conducted through the platform.
Failure to provide sufficient documentation may result in suspension or termination of messaging services or termination of the Customer account.
Customers are solely responsible for all data uploaded, stored, or managed within the BizApp247 platform, including all contact information and marketing databases.
Baytech Companies, LLC does not independently verify the origin, ownership, legality, or consent status of contact lists uploaded by Customers.
The BizApp247 platform operates as a software system that enables communication and data management tools but does not serve as the legal originator or controller of Customer contact data.
Customers are fully responsible for ensuring that their contact databases comply with all applicable laws including but not limited to:
• the Telephone Consumer Protection Act (TCPA)
• the CAN-SPAM Act
• Federal Communications Commission (FCC) regulations
• CTIA messaging guidelines
• state telemarketing laws
• applicable privacy and data protection laws
BizApp247 actively monitors platform usage patterns in order to protect the system, messaging infrastructure providers, telecommunications carriers, and platform users.
If Baytech Companies, LLC reasonably suspects that a Customer is using unlawfully obtained contact data or engaging in abusive messaging practices, BizApp247 reserves the right to take protective action including but not limited to:
• requesting proof of consent documentation
• suspending messaging capabilities
• disabling phone numbers
• pausing messaging campaigns
• restricting account access
• permanently terminating the Customer account
These actions may occur without prior notice where necessary to protect the platform, messaging infrastructure providers, telecommunications carriers, or other users.
Customer agrees to defend, indemnify, and hold harmless Baytech Companies, LLC, BizApp247, and their respective officers, directors, employees, contractors, agents, and affiliates from and against any and all claims, investigations, complaints, damages, liabilities, fines, penalties, settlements, losses, and legal expenses arising from or related to:
• unlawful contact databases
• unauthorized data collection
• lack of recipient consent
• TCPA violations
• CAN-SPAM violations
• privacy law violations
• consumer protection violations
• spam complaints
• regulatory investigations
• lawsuits related to Customer messaging activity
This indemnification obligation survives termination of the Customer’s account and use of the BizApp247 platform.
Baytech Companies, LLC and the BizApp247 platform are not responsible for:
• the legality of Customer contact databases
• the consent status of recipients
• the origin of contact lists
• Customer compliance with marketing or telemarketing laws
• regulatory investigations related to Customer messaging activity
Customers acknowledge that BizApp247 provides software tools only and does not control how Customer data is collected, stored, or used outside the platform.
Customers found to be using stolen, scraped, purchased, or otherwise unlawful contact databases may have their accounts terminated immediately without notice and without refund.
In cases of serious violations, Baytech Companies, LLC reserves the right to report unlawful activity to appropriate parties including but not limited to:
• telecommunications carriers
• messaging aggregators
• compliance registries
• regulatory authorities
• law enforcement agencies
This Agreement represents the entire agreement between the parties and supersedes all prior agreements.
